About This Cause
RECITALS AND DEFINITIONS 1.1 Name. The name of the organization is CALIFORNIA TASK FORCE 3 FOUNDATION, hereinafter referred to as “The Foundation." 1.2 Charitable Purpose. This Foundation is organized and operated exclusively for charitable purposes within the meaning of Section 501(c)(3) of the Internal Revenue Code of 1986 (hereinafter the “Code”) or the corresponding provision of any future applicable United States Internal Revenue law, including the making of distributions to organizations that qualify as exempt organizations under Section 501(c)(3) of the Code. 1.3 Specific Purpose. The specific and primary purpose of the Foundation shall be to engage in any lawful act or activity to raise funds and receive charitable donations to distribute for charitable purposes in support of the Urban Search and Rescue Program known as California Task Force 3. 1.4 Limitations. Notwithstanding any other provision of these Bylaws, this Foundation shall not (except to an insubstantial degree), engage in any activities or exercise any powers that are not in furtherance of the purposes of this Foundation and the Foundation shall not carry on any other activities not permitted to be carried on (i) by a corporation exempt from federal income tax under Section 501(c)(3) of the Code or the corresponding provision of any future United States Internal Revenue law, or (ii) by a corporation, contributions to which are deductible under Section 170(c)(2) of the Code or the corresponding provision of any future United States Internal Revenue Law. 1.5 Nonpartisan Activities. The Foundation has been formed under the California Nonprofit Public Benefit Corporation Law for charitable purposes described above, and it shall be nonprofit and nonpartisan. No substantial part of the activities of this Foundation shall consist of carrying on propaganda, or the publication or dissemination of materials with the purpose of attempting to influence legislation, except as provided in Section 501(h) of the Code. This Foundation shall not participate in or intervene in (including publishing or distributing statements) any political campaign on behalf of any candidate for public office. 1.6 Dedication of Assets. The properties and assets of this nonprofit Foundation are irrevocably dedicated to charitable purposes. No part of the net earnings, properties, or assets of this Foundation, on dissolution or otherwise, shall inure to the benefit of any private person, individual, or any Director of this Foundation. On liquidation or dissolution, all assets remaining after payment, or provision for payment, of all debts and liabilities shall be distributed and paid over to an organization organized and operated exclusively for charitable purposes, provided such which organization established its tax exempt status under Section 501(c)(3) of the Code.
