Mission Statement
"The Second Amendment Law Center is a premier Second Amendment scholarship and legal resource center committed to defending and preserving Second Amendment rights. Our mission is to reinforce the Second Amendment’s mandate that our government cannot unduly restrict law-abiding individuals from owning and using firearms for sport, hunting, self-defense, and other lawful purposes. The Founding Fathers learned from hard experience that the Second Amendment recognizes a natural right to self-defense, to bear arms, and to protect that right from government infringement. The right to keep and bear arms is fundamentally an individual one, not a “collective” right of state governments to arm a state run militia. Whether it be hunting for sustenance or conservation and sport, recreational shooting with family and friends, competitive shooting, or defense against aggressors both criminal and tyrannical, our basic human freedoms rely on the individual right to bear arms. If that right is weakened, all of the fundamental American freedoms that flow from it will be lost as well.
About This Cause
THE WORK OF THE SECOND AMENDMENT LAW CENTER Second Amendment rights litigation is not easy. Prevailing in what is often a hostile political environment in legislatures and courts takes experience, knowledge, skills, and resources beyond what most lawyers of advocacy groups possess or have access to. Constitutional rights advocacy and litigation is not a new venture for the team of professionals at the 2ALC. For decades, our “A-team” of lawyers, legal and historical scholars, political advisors and technical experts have been involved in numerous lawsuits on behalf of non-profit advocacy associations such as the National Rifle Association, the California Rifle & Pistol Association, Gun Owners of California, and many others. Our legal team has also helped industry trade associations, law enforcement organizations, licensed firearm manufacturers and retailers, trainers, shooting ranges, and individual gun owners. 2ALC continues to serve the Second Amendment community in the following ways: Public Outreach: We strive to increase awareness of current issues in firearm law and to serve as a comprehensive resource for Second Amendment scholarship, as well as legal analysis of relevant court decisions and pending legislation. Education & Training: We offer education and training to better equip gun owners, firearm businesses, and the general public in navigating the increasingly complex world of firearm law and regulation. We also offer Continuing Legal Education (CLE) seminars and webinars for law firms and attorneys interested in learning more about rapidly evolving Second Amendment jurisprudence. Impact Litigation: Our experienced legal A-team works tirelessly in courts around the country to challenge misguided and unconstitutional restrictions on Americans’ right to bear arms. Test cases moving through the courts today will establish the scope of the right to keep and bear arms for future generations. The Second Amendment Law Center is fighting on the front lines of that battle. Amicus Support: Our attorneys have been filing amicus (or “friend of the court”) briefs in worthwhile Second Amendment and other firearms-related lawsuits for decades. With these amicus briefs, we help educate the courts about important aspects of cases that impact the lives and rights of our supporters, gun owners, and all Americans. Legal Research, Analysis and Scholarship: Our attorneys and members of the Center’s Advisory Board have dedicated their lives and careers to generating a substantial body of Second Amendment and firearms-related scholarship. Through this work we provide cutting-edge legal analysis on the firearms-law issues of the day to better equip gun owners, lawyers, advocates, and everyday Americans with the knowledge to fight back against the anti-gun-owner lobby’s never-ending attempts to water down the Second Amendment’s protections. Media Resource: We serve as important resource for reporters, influencers, and other members of the media seeking to offset common misperceptions and firearms and Second Amendment rights and to provide balanced coverage of the firearms policy issues of the day. WHY SUPPORT THE SECOND AMENDMENT LAW CENTER? The text of the Second Amendment is clear. The right of the people to keep and bear arms shall not be infringed. Yet in recent decades, well-financed anti-Second Amendment politicians and organizations have advocated for strict—often total—infringements, gaslighting the American public into believing such infringements are nothing more than “common sense” “safety” measures. Nothing could be further from the truth. Following the landmark decisions in Heller v. District of Columbia which recognized the Second Amendment as an individual right, and follow-up decision in McDonald v. City of Chicago incorporating the Second Amendment as applicable to the states, and the NYRPA v Bruen decision striking down bans on the right to carry in public, many biased courts have actively sought to undermine these rulings by treating the Second Amendment as a second-class right. Instead of analyzing Second Amendment litigation under its plain text and original meaning as outlined in Heller, McDonald and Bruen, these courts have concocted biased, interest-balancing approaches that can be easily manipulated and almost always result in any level of infringement being incorrectly upheld as constitutional. Such decisions improperly elevate the role of the courts to that of policy decision-makers. One of 2ALC’s primary goals is to put an end to such practices. Doing so may well require the United States Supreme Court to once again take up another Second Amendment lawsuit and issue a decision establishing a clear framework and methodology for courts to apply in analyzing such challenges. It is 2ALC’s mission to get such a case before the Supreme Court and to set the record straight on the scope of the Second Amendment’s protections against government infringement. Over the years, our team of professionals have litigated dozens of Second Amendment cases, often in jurisdictions openly hostile to the Second Amendment, including California, Illinois, New York, Massachusetts, New Jersey, and most of the federal circuit court of appeals. Facing the challenge head-on, we have succeeded where others have tried and often failed by securing significant victories for gun owners, firearm dealers, and members of the public who cherish all rights enshrined and recognized by the United States Constitution. Recently, the National Rifle Association has faced multiple internal and external challenges and has been forced to significantly reduce its funding of Second Amendment litigation, both on a national and state level. While there are other pro-gun owner organizations out there, many use litigation primarily as a fundraising platform. They choose lawsuits based on fundraising appeal rather than sound legal strategy, often do not use qualified legal counsel, and do not dedicate the appropriate resources to properly litigate these critical and challenging lawsuits. 2ALC is committed to working with any organization that shares its mission and strategy —namely the preservation of all rights guaranteed by the Second Amendment through carefully chosen, strategically wise, and sufficiently supported efforts designed to advance the cause of Second Amendment rights.
